Welcome to Giggles Toys (“Giggles Toys,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and any related pages, features, content, and services (collectively, the “Services”), including the purchase of products from Giggles Toys.

By accessing the Services or placing an order, you agree to these Terms. If you do not agree, you must not use the Services.

Prices: Unless otherwise stated, all prices are listed in U.S. Dollars (USD).

1) Eligibility

An order confirmation message acknowledges receipt of your order request; it does not guarantee acceptance. Acceptance occurs when the order is processed for shipment or otherwise confirmed by us.

  • We may change prices, product offerings, and promotions at any time without notice, except where prohibited by law.
  • If a price is listed incorrectly due to an error, we may cancel the order and issue a refund (if charged), or contact you for instructions.

Sales tax (and similar taxes) may apply depending on your location and applicable law. Taxes and any required charges will be calculated and displayed at checkout where applicable.

4.3 Payment Authorization

By submitting payment information, you represent that you are authorized to use the payment method. You authorize us (and our payment processors) to charge your payment method for your order total, including taxes and shipping (if applicable).

5) Shipping, Delivery, and Address Accuracy

5.1 Shipping & Delivery Estimates

Delivery dates and transit times are estimates and are not guaranteed. Delays may occur due to factors outside our control, including carrier operations, weather, peak demand periods, and customs processes where applicable.

5.2 Shipping Address

You are responsible for providing a complete and accurate shipping address. We are not responsible for delivery issues caused by an incorrect or incomplete address provided at checkout.

6) Returns, Refunds, and Cancellations

7) Product Information; Availability; Variations

We strive to ensure product descriptions, specifications, and images are accurate. However:

  • Colors and appearance may vary by device and display settings;
  • Packaging, instructions, or included components may vary; and
  • Products are subject to availability and may be modified or discontinued at any time.

To the extent permitted by law, minor differences in color, packaging, or presentation do not constitute a defect.

8) Promotions and Discount Codes

Promotions, discount codes, and special offers:

  • Have no cash value unless required by law;
  • Cannot be combined unless expressly stated; and
  • May be modified, suspended, or discontinued at any time.

9) User Content (Reviews, Comments, Submissions)

If you submit reviews, comments, images, videos, or other content (“User Content”), you agree that:

  • Your User Content is accurate to the best of your knowledge and does not violate any law or third-party rights;
  • You will not submit content that is unlawful, deceptive, infringing, defamatory, harassing, or obscene; and
  • You grant Giggles Toys a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, distribute, and adapt your User Content for operating, marketing, and improving the Services.

We may remove or refuse to publish User Content at our discretion, to the extent permitted by law.

10) Prohibited Conduct

You agree not to:

  • Use the Services for unlawful purposes;
  • Interfere with, disrupt, or attempt to compromise the security or functionality of the Services;
  • Attempt unauthorized access to accounts, systems, or networks;

We may suspend or terminate access for suspected violations.

12) Toy Safety and Use

  • Always follow the product’s age grading, safety warnings, instructions, and supervision guidance.
  • Some products may contain small parts and present a choking hazard. Keep such products away from children under 3 years unless specifically indicated otherwise.

13) Third-Party Links and Services

The Services may contain links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party sites is at your own risk and subject to their terms.

14) Disclaimers

  • Our total liability for any claim arising out of or relating to the Services or products will not exceed the amount you paid to Giggles Toys for the specific product(s) giving rise to the claim.

16) Indemnification

You agree to indemnify and hold harmless Giggles Toys from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your misuse of the Services; or
  • Your violation of any law or third-party rights.

17) Privacy
